Terms and Conditions

1. Subject

These general conditions of sale (hereinafter, "Conditions") regulate the offer and sale of products through the e-commerce site Vybes.it, pursuant to Legislative Decree 6 September 2005, n. 206 ("Consumer Code") and Legislative Decree 9 April 2003, n. 70 (implementation of Directive 2000/31/CE on electronic commerce).

Pursuant to Article 7 of Legislative Decree 70/2003, the seller provides clearly and directly the information necessary for identification.

3. Products and Prices

All prices are expressed in Euro (€) and inclusive of VAT pursuant to D.P.R. 633/1972, unless otherwise indicated.

The Seller reserves the right to change prices at any time; however, the price applied will be the one indicated at the moment of order confirmation.

Any obvious and recognizable errors in prices (pursuant to Articles 1338 and 1431 c.c.) do not bind the Seller.

Product availability is indicative and subject to order confirmation pursuant to Article 61 of the Consumer Code.

4. Payment Methods

The following payment methods are accepted:

  • Credit/debit cards (Visa, MasterCard, American Express)
  • PayPal
  • Advance bank transfer
  • Cash on delivery (where applicable)

Payment must be made in full at the time of order.

Product ownership transfers to the Buyer only at the moment of full payment of the price, pursuant to Article 1523 c.c.

The Seller reserves the right to perform anti-fraud checks and may request additional documentation or refuse suspicious orders.

5. Shipments and Delivery

Shipments are made via selected couriers pursuant to Article 1510 c.c.

  • Delivery times: 2-7 business days
  • Shipping costs: variable depending on destination and weight

Delivery times are indicative and not binding, except as provided in Article 61 of the Consumer Code.

Any additional costs (customs, tax or import) are the responsibility of the Buyer.

The risk of loss or damage to goods passes to the consumer at the moment of delivery pursuant to Article 63 of the Consumer Code.

6. Right of Withdrawal and Returns

Pursuant to Articles 52 et seq. of the Consumer Code, the customer consumer has the right to withdraw from the contract within 14 days from delivery of the products, without obligation to provide reasons.

The right of withdrawal must be exercised by written communication (email or PEC).

Exclusions from the right of withdrawal:

Pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded in the following cases:

  • sealed products that are not suitable for return for hygiene or health protection reasons, if opened after delivery

Return Conditions:

The return is accepted only if:

  • the product is intact and unused
  • the original packaging is intact and sealed
  • any accessories and documentation are present

Return costs are the responsibility of the customer, pursuant to Article 57 of the Consumer Code.

Refund:

The refund will be made within 14 days of receipt of the return or proof of shipment, using the same payment method, unless otherwise agreed (Article 56 Consumer Code).

The Seller may withhold the refund until receipt of the goods.

7. Legal Warranty and Limitations of Liability

Pursuant to Articles 128–135 of the Consumer Code, products are covered by legal warranty of conformity of 24 months for consumers.

In case of breach of conformity, the customer is entitled, free of charge, to restore conformity by means of:

  • repair or replacement
  • price reduction or contract termination in the cases provided

The Seller is not responsible for:

  • improper or non-compliant use of products
  • indirect or consequential damages (e.g. loss of profit)
  • site interruptions or malfunctions not directly attributable

The mandatory provisions of law remain unaffected.

8. Privacy and Cookies

The processing of personal data takes place in accordance with Regulation (EU) 2016/679 (GDPR) and Legislative Decree 196/2003 as amended by Legislative Decree 101/2018.

9. Applicable Law and Jurisdiction

These Conditions are governed by Italian law.

Pursuant to Article 66-bis of the Consumer Code:

  • for consumers, the competent court is the one of the place of residence or domicile
  • for professionals, the Court of Perugia is exclusively competent

The possibility of resorting to alternative dispute resolution tools (ADR/ODR), including the European ODR platform pursuant to EU Regulation n. 524/2013, is preserved.

10. Modification of Conditions

The Seller reserves the right to modify these Conditions at any time.

Modifications will take effect from the date of publication on the site and will apply to orders made subsequently.

11. Security

The site adopts adequate technical and organizational measures pursuant to Article 32 of the GDPR, including:

  • HTTPS protocol
  • firewall and monitoring systems
  • periodic backups
  • limited access and authentication

These measures aim to ensure confidentiality, integrity and availability of data.

12. Modifications

PACO S.R.L. may update these terms unilaterally, at any time and without notice.
